    I'm Dave Kelly. I'm a lawyer practicing in the Minneapolis, Minnesota area. It seems I am spending an increasing percentage of my time preparing and filing bankruptcies. The biggest part of the project is usually preparing the petition. Plan on at least three sessions in my office of about an hour and a half duration. There should be a more efficient way of doing it, but I haven't found it. It seems to me that if you don't take the proper time, there's a lot more risk. I have top-of-the-line software for preparing the petition. This is necessary because some of the forms contain complicated calculations based on U.S. Census data or IRS data. What I do with my clients is sit down with the computer monitor turned where they can see it and start going through the questions one at at time. The list of what I may ask you to bring to me can vary quite a bit from case to case. Typically, however, I will be asking you to bring me at least the following: Pay check stubs for all employment income during the past seven months. Your state, federal and property tax returns for the past two calendar years. Statements for all of your bank accounts for the past seven months. Recent statements for your mortgages, home equity loans and automobile loans. A list of all your debts along with a stack of your most recently received bills for each one. A copy of the deed to your home and copies of deeds to any other real estate you may own. Paperwork on any legal action which is currently pending or which ended in the past two years. A credit counseling certificate from a qualified agency. Here is a link to the court's list of qualified providers. A recent credit report for yourself. Your bankruptcy attorney will also need credit reports from all three credit reporting bureaus. If you come to the Laurel offices of the Botelho Law Group, we will provide all of these current reports for you on one easy-to-read statement, this is included in your bankruptcy legal fees. You will also need information on any and all motor vehicles you own including title, loan documentation, valuation, proof of insurance and registration. A list of residence independents who live and reside in your household must also be provided and dependents that do not live in your household also. If you have previously filed bankruptcy within the last eight years your bankruptcy lawyer will need documentation of this also. You also need to provide creditor information such as your debts, bills, demand letters and lawsuits. All paperwork pertaining to your retirement accounts and life insurance including 401(k)s, IRAs, life insurance and any other form of life insurance or retirement account. If you are a homeowner owe on real property you’ll have to provide the following documents: deed, Homestead, mortgage information including the first and last page of the mortgage the signature page and the notarization page and any foreclosure notices you have received, valuation of the property, property tax bills, insurance, and escrow account statements. If you have any proceedings in Family Court such as divorce, child support, child custody and divorce agreements please provide these to your bankruptcy attorney. You will also need to provide proof of identity in the form of one state issued photo identification and one that proves Social Security number such as your passport and Social Security number. Just recently, in the last year or so, you have heard a lot about the IRS losing files, losing emails, or servers, and there seems to be a lot of drama about that, and Congress does not know quite what to do about this situation, but in bankruptcy court, the judges know right what to do. If you go into bankruptcy court and you have lost information and you can't prove certain things, the bankruptcy judge has the ability to just simply dismiss your case and say you don't belong here so go and find your documents and come back to bankruptcy court when you are ready to disclose information. Now, I am not speaking to little issues, like "what did you do with your $500 tax refund?", but rather when it gets into large issues like "What did you do with your $8,000 tax refund?" or business documents, or things of that nature, you can rest assured that the bankruptcy court or the trustee will ask you for those documents.
